Check 21 ActThe Check 21 Act, which became effective October 28, 2004, was enacted to improve the overall efficiency of our nation's payment system, and to reduce dependency on ground and air transportation of checks between banks and processing centers. When the 9/11 attacks occurred, the country's air transportation systems were immobilized, not allowing checks to be flown from city to city for clearing. As a consequence, the concept of converting paper checks to electronic transactions was born and is now a federal law known as the Check 21 Act. As part of Check 21, your checks may clear faster. Since your paper check will be transmitted electronically, there will be less float (the time between when a check is written and when it clears.) Consumers will need to make sure that adequate funds are in the account to avoid problems. Even if your paper checks are truncated (or stored electronically and then destroyed), it will still be possible for you to obtain copies of "substitute checks".
